General Terms & Conditions of Sale

No order is binding on Klass Mechanical Sales Ltd. until accepted and acknowledged in writing. Klass Mechanical Sales Ltd must approve all errors and / or omissions.

Klass Mechanical Sales Ltd. is not responsible for any losses, delays and /or damages caused by fires, strikes, lockouts, accidents, government acts or requirements, embargoes, insurrections, acts of God, or by any cause beyond its reasonable control or that of its suppliers.

An order cancelled at any time will be subject to cancellation charges.

Goods may be returned only with prior approval and must be accompanied by a return authorization (to be provided by Klass Mechanical Sales Ltd.). The amount of credit will depend upon the valuation & condition of the goods returned. Please note that freight charges on returned goods are the responsibility of the purchaser.

All goods are the property of Klass Mechanical Sales Ltd. until payment is received in full.

All prices are firm for (30) thirty days from date of quotation unless otherwise stated. On freight allowed shipments, Klass Mechanical Sales Ltd. reserves the right to select the carrier and routing

All orders are subject to the goods and services tax (GST). All quotations are GST extra unless otherwise stated.

Payment in full is required upon receipt of, or delivery of equipment. For customers with approved credit, terms are net (30) thirty days from date of invoice. Shipments & deliveries will only be made once approval of credit has been established, or when special arrangements have been made. Partial shipments will be billed on a pro rata basis. Outstanding accounts will be subject to a 2% monthly service charge. Holdbacks for any reason are not permitted.

Release of goods for manufacture will be from the date of approved shop drawings and a confirming purchase order are received. Submittal drawings are not issued prior to receipt of purchase order. Prices quoted are for shipments to be made within six (6) months from date of purchase order.

The receiving contractor is responsible to receive and inspect the shipment of equipment upon arrival and to report any damage immediately to the shipping company and to Klass Mechanical Sales Ltd.

All goods are sold on the understanding that the purchaser and/or the installer are qualified and licensed to install, connect and start up equipment. All installations must comply with all applicable codes. Unless otherwise stated, the price quoted does not include start up.

All warranty claims will be covered under the guidelines of the individual manufacturers standard warranty policy. All warranties are for repair and/or replacement of defective parts, FOB the manufacturers plant, and do not cover labour or transportation charges. Unless otherwise stated, the warranty is for one (1) year from date of purchase. All defective parts must be returned prepaid to the manufacturers factory for inspection. Warranty does not apply to goods for which payment in full is not received.

Klass Mechanical Sales Ltd. will not be responsible for any consequential damages of any type resulting from any defect, either in materials, design and/or construction arising from the use, or lack of use of the products supplied.
